1. WHY DID I RECEIVE A NOTICE? 

You were mailed a letter (called a “Notice”) and a Claim Form, because a lawsuit against P66 has settled. The lawsuit made claims for all current and former Construction Field Representatives (“CFR’s”) and Hayes Field Services (“HFS”) staffed to P66 at any time from May 20, 2017 through the present who were classified as independent contractors and received a day rate with no overtime compensation. P66 denies these allegations and contends that you were properly classified as an independent contractor and contends it paid you lawfully and properly for your work.

Because you worked as an CFR that HFS staffed to P66 during the relevant time period and were classified as an independent contractors and paid a day rate with no overtime, you are eligible to receive money under the settlement if you fill out the Claim Form and Release (Linked Here), follow the instructions, and return or submit it to the Settlement Administrator at Hester v Phillips 66 Co. Settlement Administrator, c/o CPT Group, Inc., 50 Corporate Park, Irvine, CA 92606 by August 31, 2020

2. HOW DO I PARTICIPATE IN THIS CONFIDENTIAL SETTLEMENT?

You must fill out the Claim Form and Release (Linked Here) to receive money under the settlement. The Claim Form and W-9 must be returned to the Settlement Administrator, at Hester v Phillips 66 Co. Settlement Administrator, c/o CPT Group, Inc., 50 Corporate Park, Irvine, CA 92606 , by U.S. Mail (postmark date), fax, E-Mail,  and/ or submitted online by August 31, 2020, if you want to receive money from the settlement.  

You must timely and accurately complete the Claim Form and Release in order to receive compensation.  All information you provide will be securely and confidentially maintained.

If you do not want to accept the settlement, simply do nothing.

3. How do I Receive My Settlement Payment?

By timely submitting and signing the Claim Form and Release (Linked Here) you will be entitled to a payment from the settlement. Your settlement payment was based on the number of hours and weeks you provided services to P66 during the relevant period.

4. WHAT HAPPENS IF I SUBMIT MY CLAIM FORM?

If you return or submit the Claim Form by August 31, 2020:

  • You will be acknowledging that you are represented by JOSEPHSON DUNLAP LLP and BRUCKNER BURCH PLLC (“Class Counsel”) and that you will be bound by the terms of the Settlement Agreement and Release signed by the Named Plaintiff in this case.  You will not have to pay Class Counsel any money directly.
  • You will be waiving and releasing any and all claims for unpaid wages or overtime and any other claims for unpaid compensation against P66 during the period beginning three years back from the date you sign the enclosed Claim Form and Release.
  • You will receive your settlement payment.
  • You will be responsible for notifying the Settlement Administrator, CPT, and/or Class Counsel if your contact information changes following your submission of the Claim Form and Release.

5. WHEN WILL I RECEIVE MY MONEY?

Individual shares of the Settlement will be mailed by approximately September 1, 2020.

6. WHAT DOES P66 THINK?

P66 believes you were classified and paid correctly and fairly for the services you provided to  P66. P66 nonetheless believes this settlement is a business solution to this dispute.

7. WHAT IF I HAVE OTHER QUESTIONS?

The deadline for receiving your completed Claim Form and Release will not be extended under any circumstances.

If your signed and completed Claim Form and Release is not postmarked, faxed, emailed, and/or submitted online by August 31, 2020, you will not receive money from the settlement.
